1. Service Description
Karla's Love Memorial ("the Service") is a family memorial platform that uses artificial intelligence to help families preserve and celebrate the lives of loved ones. The Service includes AI-generated storybooks, character portraits, voice experiences, photo and video preservation, and community memorial pages.
The Service is operated by Karla's Love Memorial and is hosted in the United States.
2. User Accounts
To access certain features, you may create an account using a magic link sent to your email address. You are responsible for maintaining the confidentiality of your login credentials. Each account is associated with a "family" — a group of users sharing memorial content.
You must be at least 13 years old to create an account. Users under 18 should have parental consent. See our Privacy Policy for COPPA compliance details.
3. Billing & Subscriptions
The Service offers a one-time Legacy Package and recurring subscription plans through Stripe. Prices are listed on our Pricing page.
- Memory Echo Preview: Free. One short AI-voice memory per email per day. No account required.
- Legacy Package: One-time payment for permanent access for one deceased loved one (one trained visual identity, 3 illustrated stories, unlimited Memory Echoes for that person, AI voice chat clearly labeled as AI). The Legacy Package is non-refundable after content has been generated, because we incur AI compute costs immediately on your behalf. We will refund in full if you have not yet generated any content.
- Family Subscription Monthly: Recurring monthly billing.
- Family Subscription Yearly: Recurring annual billing.
You may cancel any subscription at any time. Upon cancellation, you retain access through the end of your current billing period. We do not offer prorated refunds for partial billing periods. The Legacy Package is permanent — there is nothing to cancel.
We reserve the right to change pricing with 30 days' notice via email. The price you paid for an active Legacy Package is locked.
4. Content & Intellectual Property
Your content belongs to you. Photos, videos, stories, voice recordings, and any other materials you upload remain your property. By uploading content, you grant us a limited, non-exclusive license to process, store, and display your content as necessary to provide the Service.
AI-generated content: Storybooks, illustrations, character sheets, and voice outputs generated by the Service are created for your personal and family use. You are free to download, share, and print them. We retain no ownership claim over AI-generated content that is based on your materials.
The Service's software, design, branding, and non-user-generated content are the intellectual property of Karla's Love Memorial and are protected by applicable copyright and trademark laws.
5. Privacy & Data Protection
Your privacy matters deeply to us — this is a memorial for people you love. We handle your data with the utmost care and respect. Our full data practices are described in our Privacy Policy & Data Protection Agreement, and our binding promises are documented in the Sacred Covenant.
Key commitments: we do not sell your data, we do not use your photos to train models for other customers, and we provide tools for data export and deletion upon request. Where these Terms and the Sacred Covenant ever conflict, the Covenant wins for you.
6. Acceptable Use
You agree not to:
- Upload content that is illegal, defamatory, or violates the rights of others.
- Use the Service to harass, impersonate (maliciously), or harm others.
- Attempt to reverse-engineer, scrape, or interfere with the Service's infrastructure.
- Use the Service for any commercial purpose beyond personal family memorials without written permission.
- Upload content depicting minors in inappropriate situations.
We reserve the right to remove content or suspend accounts that violate these terms.
7. Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. We do our best to keep your memories safe, but we are not liable for:
- Data loss due to circumstances beyond our reasonable control.
- Inaccuracies in AI-generated content (AI can make mistakes — generated stories and portraits are creative tributes, not factual records).
- Service interruptions or downtime.
- Actions of third-party services (Stripe, Google, Replicate).
Our total liability to you shall not exceed the fees you have paid in the 12 months preceding any claim.
8. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email to account holders at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
9. Termination
You may delete your account and data at any time by contacting us. We may terminate or suspend access for violations of these Terms or for any reason with 30 days' notice.
Upon termination, we will provide a reasonable window (at least 30 days) for you to export your data before deletion.
